GDPR Privacy Notice – Royal Yacht International

1. Who we are
ROYAL YACHT INTERNATIONAL is a trading name of ROYAL YACHT SARL, a company registered in the Principality of Monaco under registration number 15S06664. Our registered office is: Le Bahia, 39 Avenue Princesse Grace, MC 98000 Monaco.
For the purposes of Monaco Law no. 1.565 of 3 December 2024 on the protection of personal data and, where applicable, the EU General Data Protection Regulation (GDPR (EU) 2016/679), we act as Data Controller in respect of the personal data we collect and process.

2. What personal data we collect
We collect and process the following categories of personal data depending on your relationship with us:
• Identification & contact details: name, title, nationality, passport or ID information, address, telephone number, and email.
• Professional details: company, position, and professional contact information.
• Client & owner information: preferences, requirements for yacht charter or purchase, itinerary and travel information, dietary or special requests, and information required for contracts and compliance (e.g. KYC).
• Financial information: bank details, billing address, payment information.
• Digital data: website usage data, cookies, device identifiers, IP address, and communication preferences.
• Marketing preferences: opt-ins, event participation, newsletter subscriptions.
We do not intentionally collect sensitive (“special category”) data unless it is voluntarily provided and necessary (for example, dietary or health information for charter arrangements).

We collect data:
• directly from you (via email, phone, web forms, meetings, events, or contracts);
• from publicly available sources (yachting portals, industry directories, or your company website);
• via third parties who refer you to us (yacht owners, charter central agents, co-brokers, event partners);

4. Why we process your personal data (purpose & legal basis)
We process your data only where lawful and necessary.

Providing yacht charter, sales, and management services:
This includes handling enquiries, sending proposals, drafting contracts, coordinating logistics, and invoicing. The legal basis for this processing is the performance of a contract or steps taken before entering into a contract.
Managing relationships with yacht owners, clients, and suppliers:
Activities include communication, account management, and internal administration. The legal basis is performance of a contract.
Meeting legal and regulatory obligations:
This covers accounting, taxation, anti-money laundering (AML) and know-your-customer (KYC) checks, and responding to authorities. The legal basis is a legal obligation.
Sending marketing communications:
Examples include newsletters and event updates. The legal basis is consent (opt-in).
Sending invitations:
For example, invitations to yacht shows. The legal basis is the legitimate interest of the company in informing contacts about events it organizes or participates in, particularly in B2B relationships.
Improving our website and services:
This includes analytics, collecting client feedback, and security monitoring. The legal basis is the company’s legitimate interest in measuring and improving website performance.
Protecting our rights and preventing fraud or misuse:
Activities include internal monitoring, IT security, and contract enforcement. The legal basis is the company’s legitimate interest in protecting its rights in the event of disputes.

5. Sharing of personal data
We may share your personal data with:
• Yacht owners, charter operators, captains, and crew (for operational purposes);
• Other yacht brokerage houses and co-brokers (to facilitate transactions);
• Service providers acting on our behalf (IT, CRM, marketing platforms, accountants, payment processors, legal advisors);
• Authorities and regulators when required by law (customs, tax, or AML compliance);
• Partners for joint events or marketing where you have consented.
All third-party processors are bound by confidentiality and data-processing agreements ensuring compliance with Monaco Law 1.565 and, where applicable, the GDPR.

6. International transfers
Given our international operations, your data may be transferred to recipients located outside Monaco or the European Economic Area.
In such cases, we ensure an adequate level of protection by:
• relying on adequacy decisions recognised by the Monaco APDP or the European Commission, or
• implementing Standard Contractual Clauses (SCCs) or equivalent safeguards approved by the APDP and the European Commission.

7. How long we retain your data
We keep personal data only for as long as necessary for the purposes for which it was collected, and to meet legal or contractual obligations.
Typical retention periods:
• Client and transaction data: 10 years after the end of the contractual relationship (for legal/accounting purposes).
• Marketing contacts: 7 years from the last interaction unless you withdraw consent sooner.
• Staff and HR data: according to statutory retention requirements.
Once the retention period expires, data is securely deleted from digital and paper supports.

8. Your rights
Under Monaco Law 1.565 and, where applicable, the GDPR, you have the following rights:
• Access: obtain confirmation whether we process your personal data and a copy of it.
• Rectification: request correction of inaccurate or incomplete data.
• Erasure: request deletion of your data where legally possible (“right to be forgotten”).
• Restriction: request limitation of processing in certain cases.
• Objection: object to processing based on legitimate interest or for direct marketing.
• Portability: request data in a structured, machine-readable format.
• Withdraw consent: at any time, where processing is based on consent.
